Website and ordering terms
What this site is, what an order through it means, and what happens next.
1These terms
They cover using this website, placing an order through it, and the basics of the service that follows. Where we have agreed something different with you in writing, that is what applies.
2What is on this site
Plan details, prices and speeds are a guide and can change. Prices shown on the home, mobile, broadband and family pages include GST. Business broadband prices are shown excluding GST and say so. Broadband speeds are the maximum the plan supports; what your connection actually reaches depends on the line to your property, the wiring inside it and your equipment.
The address checker confirms that an address exists. It does not confirm what that address can be connected to. We check the line with the network operator and tell you before anything is ordered.
3Placing an order
An order placed through this website is a request, not a contract, and nothing is charged on this website. We check what your address can get, confirm the price with you, and only then start the transfer. A contract starts when we accept your order and the service is set up.
We can decline an order, for example where the address cannot be served, where the details given do not match the account being transferred, or where we cannot confirm you are entitled to authorise the transfer.
The date and time you choose are a preference, not a booking. Transfers run on business days, not on the day you order, and not in the evening or at the weekend. We can only work to your preferred time if the details you gave us are correct and the transfer runs cleanly. If something comes back wrong, or your current provider or the network operator holds things up, we cannot guarantee the time, and we will tell you as soon as we know.
4Bringing your number across
You have to be the account holder for the number, or be authorised to act for them. The order form asks you to confirm that, and we rely on it.
A security text comes from 2542 asking you to approve the transfer. If you reply NO, or do not reply in time, nothing moves. Do not cancel your current service before the transfer completes: cancelling early is the single most common reason a transfer fails. Your old provider will usually send one final bill after the move, and anything you owe them is still owed.
5Unlimited, and Endless
Unlimited broadband plans are not shaped or throttled. Fair use means the usage patterns of 99%% of customers, checked monthly. If your usage starts affecting other customers we will ring you and work it out, and nothing changes on your connection without that call.
On mobile, an Endless plan runs at full speed to the plan allowance and then continues at a reduced speed until the next billing date, at no extra charge. MNT Basic is a capped plan, so data stops at the allowance rather than slowing.
6How long the service runs for
Home mobile and broadband plans are on an open term. There is no fixed contract, no joining fee and no termination fee, and you can leave when you like.
Business connections are normally set up on a twelve month term. We will tell you the term before you commit, and it will be in the order we confirm with you. At the end of the term you can leave or renew for a further term, whichever suits. Ending a term early may incur an early termination charge, and we will tell you what it is before you commit.
7Paying for it
Invoices are due on the date shown on them. If an invoice is not paid by then we may suspend the service until it is, and if it stays unpaid we may disconnect it and recover what is owed, including the reasonable costs of recovering it. A late payment fee and a reconnection fee may apply. The amounts are set out in the agreement we confirm with you and on your invoice, and we will not charge you an amount you have not been told about.
Suspension does not stop the plan charges for the period you are suspended, and it does not end the contract.
8The modem
Any modem that works on fibre works on our network, so you are welcome to keep the one you have. If you take one from us there are two ways to do it.
Bought outright. You pay the price listed on this website once and the modem is yours. Nothing to return.
Rented. The modem stays ours. You pay the monthly rental for as long as you have it, and it comes back to us in working condition when the service ends.
If a rented modem comes back damaged or no longer working, whether that is physical damage or anything else that stops it functioning, you pay the price of a replacement, which is the price listed on this website at the time. If you think the modem was not working properly when you received it, tell us at the start and we will sort it out rather than charge you for it at the end.
9Your rights as a consumer
Nothing on this website limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are a consumer. Where you acquire services for the purposes of a business, those Acts may be contracted out of to the extent the law allows.
10If something goes wrong
Ring 09 2002 666 or email contact@mynextel.nz and talk to a person. We aim to come back to you the same day, and most things are sorted on the call.
If we cannot sort it out between us, you can take the matter to the Disputes Tribunal. A complaint about privacy can go to the Office of the Privacy Commissioner on 0800 803 909.

12Changes
We may update these terms. The version on this page, with the date at the top, is the one that applies to an order placed after it.
